The latest version of this document is always available at gesento.ai/en/terms.

These Terms of Service (“Terms”) govern the use of the Gesento.ai service (“Service”). The Service is provided by Nordic Learning Intelligence Oy (“Company”). By subscribing to or using the Service, you agree to these Terms.

The agreement framework consists of these Terms of Service and the Privacy Policy. A Customer Organization purchasing the Service is additionally subject to a separate Data Processing Addendum (DPA) as well as an order confirmation or service agreement.

1. Service Provider and Contact Details

The Service is provided by:

Nordic Learning Intelligence Oy (Business ID 3599307-3), Helsinki.

  • Service and order inquiries: info@gesento.ai
  • Privacy matters: privacy@gesento.ai

2. Definitions

  • Service: The Gesento.ai web application, its software, and related coaching content.
  • User: Any natural person who actually uses the Service.
  • Customer Organization: A company, organization, or other entity that purchases rights of use (licenses) to the Service for its representatives or employees.
  • Authorized User: A User designated by a Customer Organization (e.g., an employee) who has been granted access to a license purchased by the Customer Organization.
  • Consumer User: An individual who purchases and uses the Service as a private individual at their own expense.

3. Service Description

Gesento.ai is a browser-based presentation skills coaching application. The User uploads videos of themselves presenting to the Service, and the Service generates data-driven coaching feedback based on those videos to develop presentation skills.

The Service operates in a browser environment. Features may be added, modified, or removed as part of the Service's ongoing development in accordance with Section 13.

4. Formation of Agreement and Merchant of Record

The agreement is formed when an order is confirmed and payment is accepted, or when the parties sign a separate order confirmation/service agreement. Use of the Service requires a minimum age of 18 years.

  • Payment Card and Online Store Purchases: For orders placed via our website, our payment partner Paddle acts as the seller (under the Merchant of Record model). Paddle handles commercial transactions, payment processing, invoicing, and payment-related refund requests in accordance with its own terms.
  • Direct Invoicing (Customer Organizations): Where direct invoicing has been agreed upon with a Customer Organization, Nordic Learning Intelligence Oy acts as the seller in accordance with the payment terms agreed in the order confirmation.

The Company remains solely responsible for the content, delivery, and technical support of the Service in all situations.

5. Pricing, Billing, and Renewals

Prices and tax-inclusive total amounts for orders placed through the online store are displayed at checkout prior to order confirmation. If an online purchase is automatically recurring, this will be stated before ordering, and reminders for annual subscriptions will be sent prior to the start of a new billing cycle. You may cancel a recurring subscription at any time before the next billing cycle begins. The cancellation takes effect at the end of the current billing cycle, and no new period will be billed.

For direct invoicing, the prices, billing cycles, and payment terms agreed upon in the separate order confirmation apply. Failure to pay an invoice may lead to suspension of the Service in accordance with Section 12.

6. Right of Withdrawal (Consumers)

Consumer customers have a 14-day right of withdrawal from distance sales contracts in accordance with consumer protection laws. Cancellations and refunds are processed via our payment partner Paddle's cancellation mechanism (via the link provided in the order confirmation or through Paddle Customer Support). Cancellation notices sent directly to the Company (info@gesento.ai) will be forwarded to Paddle for processing.

If you request the delivery of the Service to begin immediately before the end of the 14-day withdrawal period, you acknowledge that your right of withdrawal expires once the digital service has been fully delivered. If you cancel the contract during delivery, we will charge a proportionate fee for the portion delivered up to the point of cancellation.

7. Ownership Rights and License

  • User Content and Ownership: The User retains all ownership and copyrights to their uploaded videos and materials. The User grants the Company the right to process the videos to generate coaching feedback in accordance with the Privacy Policy. The Company does not use User-uploaded videos or personal coaching results to train or develop any AI models.
  • Received Feedback: The User receives a personal right to use and share the coaching feedback generated for them by the Service.
  • Gesento Ownership Rights and Trade Secrets: The Service, its software, source code, user interfaces, educational materials, trademarks, algorithms, and underlying coaching methodology (Language of Presenting / Esiintymisenkieli™) are the exclusive property and protected trade secrets of the Company or its licensors.
  • Right of Use (License): The User is granted a personal, fixed-term, non-exclusive, non-transferable, and revocable right to use the Service to practice their presentation skills during the active subscription period. The User may not copy, publish, license, or resell the general educational materials or application content of the Service.

8. Acceptable Use and Prohibitions

Use of the Service must comply with the following conditions. Violation of these conditions constitutes a material breach of contract:

A. Rules Regarding Uploaded Content:

  • Solo Appearance: The User warrants that only the User themselves appears and speaks in videos uploaded to the Service. Filming, featuring, or uploading the voice of other individuals to the Service is strictly prohibited.
  • Prohibited Material: Uploading unlawful, offensive, violent, pornographic, or otherwise sensitive material is strictly prohibited.
  • Third-Party Rights: The User warrants that uploaded material does not infringe on third-party copyrights, privacy rights, or other rights.

B. Prohibitions Regarding Technical Use of the Service:

  • Reverse Engineering Prohibition: Decompiling, reverse engineering, or automatically analyzing the Service's source code, databases, or evaluation algorithms is prohibited.
  • Automation and Data Collection: Automated use of the Service (such as using bots, web crawlers, or automated data extraction tools) as well as unauthorized automated collecting or mass downloading of educational content or materials is prohibited.
  • Compromising Security: Unauthorized probing, overloading, circumventing security measures, or seeking unauthorized access to the Service's systems is prohibited.
  • Transfer of Credentials: Selling, sublicensing, renting, or making Service account credentials available to third parties is prohibited.

9. Customer Organizations and Authorized Users

When a Customer Organization purchases access rights to the Service for its employees or representatives (“Authorized User”):

  • Each Authorized User is the sole holder of their personal account. The Customer Organization cannot view the videos, coaching results, or feedback uploaded or received by an Authorized User.
  • The Customer Organization is reported only on license activation status and the number of uploaded videos.
  • Results generated by the Service may not be used in any employment decision concerning an Authorized User (e.g., performance evaluation, promotion, compensation, or termination of employment).

10. Nature of Service and Disclaimer

The Service serves as a tool for practicing and developing presentation skills.

The Service evaluates the following aspects of your presentation: body language, vocal technique, eye contact, movement, emotional expression (optional and in consumer use only, see the Privacy Policy), use of presentation materials, and grammar.

We utilize a multi-stage analysis process for evaluating presentations, consisting of our proprietary algorithms, computer vision, acoustic speech analysis, and AI models executed in a secure cloud environment.

Feedback produced by the Service does not constitute medical, psychological, therapeutic, legal, or financial advice, nor does it replace personal expert consultation.

Automated analysis may contain errors or inaccuracies. The Company does not guarantee that feedback is error-free or that following it will lead to any specific outcome (such as securing a job, funding, or contract). The benefit derived from the Service depends on the User's own active practice and applying the application's guidance. The User remains solely responsible for their decisions, performance, and actions taken based on the feedback.

11. Limitation of Liability

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. To the extent liability cannot be fully excluded under law, the Company's total liability is limited to the fees paid for the Service during the six (6) months preceding the event giving rise to the claim: for a User who has purchased the Service themselves, the fees paid by that User; for a Customer Organization and its Authorized Users, the fees paid by the Customer Organization.

This limitation of liability does not limit consumer statutory rights under the Finnish Consumer Protection Act (KSL) or other mandatory legislation regarding defects in digital content and services.

12. Suspension of Service

If a User breaches these Terms, the Company has the right to restrict or suspend the User's access to the Service. The Company may suspend or restrict the User's right of use immediately and without prior notice if the User commits a material breach of contract, such as transferring their personal account or login credentials to a third party, uploading material featuring other individuals, or compromising system security or operation.

In cases of minor breaches, we will notify the User of the suspension and its reason in advance and grant a reasonable timeframe to remedy the situation before restricting access rights.

13. Modifications to Service and Terms

We update these Terms as the Service and legislation evolve. We will notify Users of material changes within a reasonable timeframe, at least fourteen (14) days prior to the changes taking effect, unless legislation or security reasons require faster updates.

If the Service is discontinued or modified such that paid subscription time remains unused, we will refund the unused portion in proportion to the remaining subscription period.

14. User Data Upon Termination

When a fixed-term subscription ends, the account remains accessible for login, but paid features of the Service (such as coaching feedback and learning content) will be locked.

We retain your coaching data for 90 days following subscription termination so you can reactivate your subscription without losing progress, after which it is deleted. If you wish to back up your uploaded materials, we recommend downloading them prior to the end of your subscription period. You may also exercise your GDPR right of access to your data as described in the Privacy Policy.

15. Force Majeure

The Company shall not be liable for delays or damages resulting from obstacles beyond its reasonable control (such as general telecommunication network outages, major server host disruptions, power outages, strikes, or government orders). If a force majeure event continues for more than 30 days, either party may terminate the agreement without liability.

16. Assignment

The User may not assign their rights or obligations under this agreement to a third party. The Company has the right to assign the agreement in connection with a business sale, merger, or other corporate restructuring by notifying the User in advance. In such case, consumer customers have the right to terminate the agreement.

17. Governing Law and Dispute Resolution

These Terms and the use of the Service are governed by the laws of Finland, excluding its conflict of law principles. In the event of discrepancies between language versions, the Finnish version shall prevail.

  • Consumer Customers: You retain all mandatory statutory rights under the consumer protection laws of your country of residence. You may bring disputes regarding the Service to the competent court of your place of residence or to the Finnish Consumer Disputes Board (kuluttajariita.fi).
  • Customer Organizations: Any disputes between the Company and a Customer Organization shall primarily be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled exclusively in the District Court of Helsinki, Finland.
